eCode and Gift Card Terms and Conditions – American Express Membership Rewards® (Updated on 08032023)

1. Information About Us and How to Contact Us

1.1 Who we are. We are Blackhawk Network EMEA Limited a company registered in England and Wales. Our company registration number is 4155659 and our registered office is at Westside, London Road, Hemel Hempstead, Hertfordshire, HP3 9TD. Our registered VAT number is 897 3979 32. We are part of the Blackhawk Network group. All references to “we”, “our” and “us” in these Terms and Conditions are to Blackhawk Network EMEA Limited.

1.2 How to contact us. You can contact us by telephone on 0345 600 2349.

1.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

1.4 ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

2. These Terms

2.1 What these terms cover. These are the terms and conditions on which we will supply an eCode or gift card to you (“Gift Card(s)”).

2.2 Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide Gift Cards to you, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

2.3 Who these terms apply to. These terms apply to consumers who are ordering and purchasing Gift Cards from us using their American Express Membership Rewards. You are a consumer if:

  • You are an individual.
  • You are ordering and purchasing Gift Cards through American Express Membership Rewards wholly or mainly for your personal use (not for use in connection with your trade, business, craft or profession).

3. Your Order

3.1 How we will process your order. We will begin processing your order once we receive it from American Express. Please ensure that you submit correct and accurate information when placing your order as American Express Membership Rewards Points refunds or order replacements will only be considered in the event of an error by us or American Express.

3.2 If we cannot fulfil your order. If we are unable to fulfil your order we, as the seller of Gift Cards, will inform you of this in writing. This might be because the Gift Card is out of stock or because of unexpected limits on our resources which we could not reasonably plan for.

4. Our Product

4.1 No exchange for cash. The Gift Cards that we provide cannot be exchanged for cash and each retailer operates its own policy on issuing change, where applicable.

4.2 You will not be compensated if the retailer becomes insolvent. The funds on the Gift Cards are not covered by the Financial Services Compensation Scheme. In the unlikely event of the issuer of the Gift Card becoming insolvent some funds on a Gift Card or eCode may not be available to spend.

4.3 Use the Gift Card within the validity period. All Gift Cards are provided with a specified validity period. After this period of time has elapsed the Gift Cards become void and cannot be redeemed. No refund will be available to you of funds which have not been redeemed by the expiry of the specified validity period.

4.4 Prohibited activity. You are not allowed sell the Gift Cards to anyone.

4.5 Gift Card restrictions will appear in the product description. Where a Gift Card is subject to additional terms mandated by the Gift Card retailer, these terms will appear in the product description on our website.

5. Points Required

5.1 Points required for the Gift Card. The Points value of the Gift Card will be indicated on the order pages when you place your order. Your American Express Membership Rewards Points will be reduced by this value.

6. Providing the Gift Card

6.1 Delivery costs. The costs of delivery are included in the Points value displayed when you place your order.

6.2 When we will provide the Gift Card. During the order process we will let you know when we will provide the Gift Cards to you.

6.3 We are not responsible for delays outside our control. If our supply of the Gift Card(s) is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.

6.4 We are not responsible if you provide us with incorrect or incomplete information. We will not be responsible for any failure or delay in providing the Gift Card(s) to you where this happens because the information you have provided is incorrect or incomplete.

6.5 When you become responsible for the Gift Card. A product will be your responsibility from the time we deliver the product to the address you gave us.

6.6 When you own the Gift Card. You own a Gift Card which is goods once you have redeemed your American Express Membership Rewards Points in exchange for the value of the Gift Card.

6.7 You need to inspect the Gift Card. You are solely responsible for inspecting the Gift Card(s) on delivery, which may be via email, and must contact us via email or telephone within forty-eight (48) hours of your delivery being made if the products you have received are incorrect, damaged or faulty or if there are any delivery discrepancies that have arisen as a result of an error by us or American Express. If we are unable to resolve the issue you must permanently delete or return all incorrect, damaged or faulty products to us as soon as possible. You are responsible for safe carriage of the Gift Card(s) to us and we recommend you obtain proof of postage. Where you are entitled to a replacement Gift Card and once we have received the returned physical Gift Card from you (or, where applicable, once you have deleted or we have cancelled the eCode) we will provide you with a replacement or equivalent product as soon as possible.

7. No Changes

Once you have placed your order and that order has been provided to us, no changes to that order can be made.

8. If There Is a Problem With the Gift Card(s)

How to tell us about problems. If you have any questions or complaints about the Gift Card(s), please contact us. You can telephone our customer service team Monday to Sunday between the hours of 08:00am to 20:00pm (excluding Christmas Day, Boxing Day and New Years’ Day) on 0345 600 2349.

9. Our Responsibility for Loss or Damage Suffered by You

We are not liable for business losses. We only supply these Gift Cards for domestic and private use.

11. Other Important Terms

Which Laws Apply to This Contract and Where You May Bring Legal Proceedings. These terms are governed by English law and subject to the exclusive jurisdiction of the English courts.
